Agreement to Terms

Welcome to The Banana App, operated by Cause Connect Pte. Ltd. (also known as "Banana App," "Banana," or "The App"). By signing up, accessing, or using our service, you agree to be bound by these Terms of Service.

By creating an account, you confirm that:

  • You have read and understood these Terms
  • You agree to comply with these Terms
  • You are at least 13 years old (or the minimum age in your jurisdiction)

If you do not agree to these Terms, you may not use The Banana App.

The Service

The Banana App is a voice communication platform that enables users to connect and speak with others across different languages. Our service provides real-time voice translation, allowing your voice to be understood in the recipient's language.

Key Features:

  • Real-time voice translation during calls
  • Cross-language communication
  • Optional voice cloning for personalized translation
  • Voice data that is processed through our servers and third-party services

Age Requirements and COPPA Compliance

The Banana App complies with the Children's Online Privacy Protection Act (COPPA) and similar international regulations.

By creating an account, you represent that:

  • You are at least 13 years of age
  • You meet the minimum age requirement in your jurisdiction
  • You have the legal capacity to enter into this agreement

If we learn that we have collected information from a user under the age of 13 without proper consent, we will promptly delete that account and associated data.

Your Data and Privacy

Your Data Belongs to You

We believe your data is yours. We do not use your data for training AI models or any purposes beyond providing and improving our service.

Voice Cloning (Optional)

  • Voice cloning is an optional feature offered at your discretion
  • You are never required to enable voice cloning to use The Banana App
  • You can delete your voice training data at any time from the Settings page
  • We will delete your training data promptly upon request

Data Retention

We retain your data as long as your service is active to provide continuous improvements and deliver a better experience. You may request deletion of specific data types at any time.

Third-Party Processing

To enable voice translation, your voice data will be passed to third-party service providers. When your data is processed by these services, their privacy policies and terms apply. By using The Banana App, you acknowledge and accept that your data may be processed by our third-party service providers under their terms.

What We Do NOT Store

We do NOT collect, store, or retain:

  • Call logs or call history
  • Transcripts or recordings of your conversations
  • The content of what you say during calls

Some data may be stored temporarily for quality assurance but will be removed within an acceptable timeframe or upon your request.

Local Device Storage

Certain data is stored privately on your device and is not accessible to us or our servers. This includes app preferences, cached data, and local settings.

Important: If you delete the app, format your device, or lose access to your device, this locally stored data will be permanently lost and cannot be recovered.

Your Responsibilities

You Are Solely Responsible For:

  • Calls you make: All calls initiated through the app
  • Content you speak: Everything you say during conversations
  • Content you receive: How you respond to and use information received
  • Your conduct: Ensuring your behavior complies with applicable laws and these Terms

Prohibited Conduct

You agree NOT to use The Banana App to:

  • Harass, abuse, threaten, or intimidate others
  • Violate any applicable laws or regulations
  • Impersonate another person or entity
  • Transmit harmful, offensive, or illegal content
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Use the service for spam or commercial solicitation

Enforcement and Account Termination

We take abuse seriously. By abusing the service, you risk losing access to The Banana App.

We reserve the right to:

  • Suspend or terminate your account at our sole discretion
  • Block or ban you without prior notice if you violate these Terms
  • Remove you from the platform without providing detailed explanations

If your account is suspended or terminated, you may apply to recover your account. However, approval or denial of such requests is at our sole discretion, and we are under no obligation to reinstate your access.

Disclaimers and Limitations

Use at Your Own Risk

THE BANANA APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We are NOT liable for:

  • Any harm, loss, or damage caused by your use of the app
  • Inaccuracies in translation or voice rendering
  • Service interruptions, errors, or technical issues
  • Loss of data stored locally on your device
  • Actions or content of other users
  • Third-party service failures or breaches
  • Any indirect, incidental, consequential, or punitive damages

Translation Accuracy

While we strive for high-quality translations, we cannot guarantee perfect accuracy. You acknowledge that translations may contain errors or misinterpretations.

Service Availability

We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue the service at any time without prior notice.

Indemnification

You agree to indemnify, defend, and hold harmless Cause Connect Pte. Ltd., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use of The Banana App
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you transmit through the service

Data Subject Rights (DSR)

We support data subject rights as required by applicable privacy laws. You have the right to access, correct, delete, or export your personal data.

Analytics and Improvement

We collect analytics data to improve our services, including usage patterns, feature interactions, and performance metrics. This data helps us understand how users interact with The Banana App and identify areas for improvement.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last Updated" date.

Your continued use of The Banana App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the service.

Governing Law and Jurisdiction

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. Any disputes arising from these Terms or your use of The Banana App shall be subject to the exclusive jurisdiction of the courts of Singapore.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
